(وهو لازم في حق الراهن) أي: بعد قبضه؛ لأن الحظ فيه لغيره، فلزم من جهته، كالضمان في حق الضامن (جائز في حق المرتهن) لأن الحظ فيه له وحده، فكان له فَسْخُه كالمضمون له.
