(فلو تلف) الرهن المؤجَرُ، أو المستعارُ بغير تعدٍّ ولا تفريط (ضمن) الراهنُ (المستعيرُ فقط) لأن العارية مضمونة مطلقًا، كما يأتي دون المؤجَر؛ فلا يضمنه بلا تعدٍّ ولا تفريط.
