(ولا) يصح رهن (ما لا يجوز بيعه من أرض الشام والعراق ونحوهما) كأرض مصر (مما فتح عَنوة) ولم يقسم؛ لما تقدم من أن عمر - رضي الله عنه - وَقَفَه، وأقرَّه بأيدي أربابه بالخراج .
