(ويؤخذ من) راهن (مُوسِر) إذا أعتق الرهن (قيمتُه) لأنه أبطل حق المُرتَهِن من الوثيقة، أشبه ما لو أتلفه (وقتَ عتقه) لأنه وقت إتلافه يكون (رهنًا مكانه) لأنها نائبة عن الرهن أو بدل عنه.
