كشاف القناعal-Buhuti

(فإن اتفقا عليه) أي: على بقاء الرهن بيد ورثة العدل، أو المُرتَهِن؛ جاز (أو) اتفقا (على عدل يضعانه) أي: الرهن (عنده) حينئذٍ (فلهما ذلك) لأن الحق لا يعدوهما.
