كشاف القناعal-Buhuti

(وإن اختلفا) أي: الراهن والمُرتَهِن (عند موت العدل) فيمن يضعانه عنده (أو اختلف الراهن وورثة المُرتَهِن) بعد موته فيمن يضعانه عنده (رفعا الأمر إلى الحاكم ليضعه بيد عدل) قطعًا للنزاع.
