(قيل له: إما أن تقبض، وإما أن تبرئ) لأن أهل الذِّمة إذا تقابضوا العقود الفاسدة جرى مجرى الصحيحة. قال عمر في أهل الذمة معهم الخمور: ولُّوهم بَيْعَهَا، وخُذُوا من أثمانها .
