(وإن جعلها) أي: الخمر (في يد مسلم، فباعها المسلم) ولو من ذمي (لم يجبر المرتَهِن على قَبول الثمن) بل ولا يجوز له قَبوله؛ لبطلان البيع، وبقاء الثمن على ملك ربه الأول.
