(و) لكن (إن كان) الرهن (مجهولًا، أو) كان (مُحرَّمًا ونحوه) كالمعدوم وسائر ما لا يصح بيعه، مما لا يقدر على تسليمه ونحوه (فباطل) لعدم حصول المقصود منه، وتقدَّم بعضه .
