كشاف القناعal-Buhuti

(وإذا فسد الرهن وقبضه المرتَهِن، فلا ضمان عليه) إن تلف بيده؛ لما ذكره من أن فاسد العقود كصحيحها في الضمان وعدمه، والرهن الصحيح غير مضمون، ففاسده كذلك.
