(وإن أبرأه) أي: الراهن (المرتَهِن من أحد الدينين) اللذين له عليه (واختلفا في تعيينه) أي: الدين المبرَّأ منه (فقول مُرتَهِن) وهو المبرئ؛ لأنه أدرى بما صدر منه، وتقدم.
