(ولو ادعى المرتهن أنه قبضه) أي: الرهن (منه) أي: الراهن، وأنكره الراهن (قُبِلَ قوله) أي: المُرتَهِن (إن كان) الرهن (بيده) أنه قبضه؛ عملًا بظاهر اليد، وإلا، فقول راهن.
