وإن استأجره المرتهن أو استعاره لم يخرج بذلك عن الرهن لأن القبض مستدام:

(وإن استأجره) أي: الرهن (المُرتَهِن، أو استعاره) المُرتَهِن (لم يخرج) المرهون (بذلك عن الرهن) خلافًا للقاضي (لأن القبض مُستدام) بيده، ولا تنافي بين العقدين
