(وإن لم يمكن بيع بعضه، بيع كله) للضرورة (وقُسم ثمنه بينهما، على حسب ذلك) فقَدْر الأَرْش من ثمنه (يكون رهنًا) عند مرتَهِن المجني عليه، وباقيه رهن عند مرتهنه.
