(ويكون) المأخوذ (رهنًا معها) كسائر أروش الجنايات. (وإن كانت الجناية) على الرهن (موجبة للمال، فما قُبض منه) أي: من المال (جُعل) رهنًا (مكانه) أي: مكان المرهون؛ لقيامه مقامه.
