(وإن وطئها) المرتَهِن (من غير إذن راهن جاهلًا التحريم، فلا حَدَّ) عليه (وولده حُرٌّ) للشُّبهة (وعليه) أي المرتَهِن (الفداء) فيفديه بقيمته يوم الولادة؛ لأنه فوَّته على الراهن باعتقاده الحرية (و) عليه (المهر) أيضًا لما تقدم.
