(وإن ضَمِنَ أحدُهما) أي: أحد الضامنين (صاحبَهُ لم يصح) ضمانه له؛ لأن الحق ثبت في ذمته بضمانه الأصل، فهو أصل، فلا يجوز أن يصير فرعًا.
