(إلا المحجور عليه لفَلَس، فيصح ضمانه) لأنه تصرُّفٌ في ذمته، وهو أهل له (ويتبع) به (بعد فكِّ الحَجْر عنه) كسائر ديونه التي في ذمته الثابتة بعد الحجر.

إذا تقرر أنه لا يصح إلا من جائز التصرُّف
