(وإن قضى الضامن الدَّيْن، أو أحال) الضامن (به) أي: بالدَّيْن (متبرِّعًا، لم يرجع) الضامن (بشيء) سواء (ضَمِنه بإذنه، أو بغير إذنه) لأنه متطوِّع بذلك، أشبه الصدقة.
