(وأيهما) أي: أيُّ شريكين (هَدَمه) أي: هَدَم ما خيف سقوطه (إذَنْ بغير إذْنِ صاحبه، فلا شيء) أي: فلا ضمان (عليه) لأنه مُحسِن، بل قياس ما سبق يرجع بما يقابل حصته من أجرة الهدم، إن نوى الرُّجوع (كما لو انهدم) المشترك (بنفسه) من غير فِعْل أحدهما.
