(ولو اتفقا) أي: الشريكان (على بناء حائطِ بستان، فبنى أحدُهما) ما عليه، وأهمل الآخر (فما تَلِفَ من الثمرة بسبب إهمال الآخر، ضَمِنه) أي: ضمن نصيب شريكه منه (الَّذي أهمل، قاله الشيخ (٢) ) لتلفه بسببه.
