(ولو كان السُّفْل لواحد والعلو لآخر) وتنازعا في السقف، ولا بيِّنة (فالسقف بينهما) لانتفاع كلٍّ منهما به (لا لصاحب العلو) وحده. ويأتي في الدعاوى بأوضح من هذا.
