(وإن وَكَّل) مدين (مودَعًا، أو غيره في قضاء دين) عنه (ولم يأمره) الموكِّل (بإشهاد، فقضاه) الوكيل (في غيبته) أي: الموكِّل (ولم يُشهِد) على القضاء (فأنكر (١) الغريم، ضمن الوكيل) لأنه مفرِّط، حيث لم يُشهِد
