الضرب الثاني ذكره بقوله: (ويصح) الاشتراك (في تملك المباحات من الاحتشاش، والاصطياد، والتلصص على دار الحرب، وسائر المباحات) لما تقدم من نصِّ الإمام واحتجاجه ، و (كالاستئجار عليها) أي: على المباحات.
