(فإن فُسخت) المساقاة (بعد ظهور الثمرةِ، فهي) أي الثمرة (بينهما) أي: المالك والعامل (على ما شرطاه) عند العقد؛ لأنها حدثت على ملكيهما، وكالمضاربة.
