(وإن لم يعلم) الولي بلوغ اليتيم في أثناء المدة، ولم يعلم اليد عتقه في أثنائها (لم تنفسخ) الإجارة؛ لأنه تصرُّف لازم يملكه المتصرِّف، كما لو زوَّج أَمَته، ثم باعها، أو أعتقها.
