(ولا تنفسخ) إجارة اليتيم أو ماله (بموت) الولي (المؤجر، ولا عزله) لأنه تصرَّف -وهو من أهل التصرُّف- فيما له الولاية عليه، فلم يبطل تصرُّفه، كما لو مات ناظر الوقف، أو عُزل هو، أو الحاكم.
