(وإن أطلق العقد) فلم يشترط إبدالًا، ولا عدمه (فله إبدال ما ذهب بسرقة وأكل، ولو معتادًا كالماء) لأنه استحق حمل مقدار معلوم، فمَلَكه مطلقًا، وتقدم بعضه.
