(فإن كانت) المؤجَرة (موصوفة في الذِّمة، لم ينفسخ العقد) بردِّها لكونها معيبة (وعلى المُكري إبدالها) بسليمة، كالمسلَم فيه؛ لأن إطلاق العقد إنما يتناول السليم.
