(فإن لم يمكن) بأن لم يوجد له مال (استدان) الحاكم (عليه) ما ينفقه عليها؛ لأنه موضع حاجة. (أو أذن) الحاكم (للمستأجر في النفقة) على البهائم؛ لأن إقامة أمين غير المستأجر تشق، وتتعذَّر مباشرته كل وقت.
