(فإن لم يستأذن) المنفقُ، من مستأجر أو غيره (الحاكمَ، وأنفق بنية الرجوع، رجع) على ربِّها بما أنفقه؛ لأنه قام عنه بواجب غيرَ متبرِّع به، وتقدم في الرهن (وإلا) ينو الرجوع (فلا) رجوع له؛ لأنه متبرعٌ.
