(وإن استأجر مُشترَك خاصًّا) كالخياط في دكان يستأجر أجيرًا فأكثر مدة معلومة يستعمله فيها (فلكلٍّ) من الخاص والمشترك (حكم نفسه) فإذا تقبل صاحب الدكان خياطة ثوب، ودفعه إلى أجيره؛ فَخَرَقه أو أفسده بلا تعدٍّ ولا تفريط، لم يضمنه؛ لأنه أجير خاص، ويضمنه صاحب الدكان لمالكه؛ لأنه أجير مُشترَك.
