(وإن استعان) المشترك (به) أي: بالخاص (ولم يعمل) المشترك (فله) أي: المشترك (الأجرة لأجل ضمانه، لا لتسليم العمل) وتقدم في الشركة أن التقبل يوجب الضمان على المتقبل، ويستحق به الربح.
