(بخلاف وكيل) إذا ادعى أنه أذن له في البيع ونحوه، لم يُقبل؛ لأن الأصل عدم الإذن.

وإن ثبتت وكالته، واختلفا في صفة الإذن؛ فقوله، كما تقدّم في الوكالة ، كالمضارب؛ لأن الأصل براءته. وعبارته موهمة. والله أعلم.
