(وإن فسخا) أو أحدهما (العقد بعد) مضي (المدة، أو) مضي (شيء منها، سقط المُسمَّى، ووجب أجر المِثْل) لتعذُّر رَدِّ المنفعة، كما لو اختلفا في المبيع بعد تلفه.
