فإذا أخذها بدمشق وطالبه ببعلبك: فإن كانت معه لزم الدفع وإلا فلا

كشاف القناعal-Buhuti

(فإذا أخذها) أي: العارية (بدمشق، وطالبه) مالكها بها (ببعلبك، فإن كانتَ معه، لزم الدفع) لعدم العذر (وإلا) تكن معه ببعلبك (فلا) يلزمه حملها إليها؛ لأن الإطلاق إنما اقتضى الرد من حيث أخذ، وإعادة الشيء إلى ما كان عليه، فلا يجب ما زاد.
