(فإن اختلفا) أي: الشفيع والمشتري (في قيمته) أي: قيمة العرض المجعول ثمنًا (والحالة هذه) أي: وهو معدوم (فقول مشترٍ) بيمينه؛ لأنه أعرف بما عقد عليه، ولأن الشِّقص ملكه، فلا ينزع منه بغير ما يدعيه بلا بينة.
