(إلا أن ينهاه) أي: الوديعَ (المالكُ عن علفها) أو سقيها، فيتركه، فتتلف (فلا يضمن) الوديع؛ لأن مالكها أذنه في إتلافها، أشبه ما لو أمره بقتلها
