(فإن عجز) المستودَع (عن صاحبها، و) عجز عن (وكيله) أو لم يقدر على أن يتوصَّل إلى أحدهما ليطالبه بالإنفاق عليها، أو استردادها، أو أن يأذنه في النفقة (رفع) المستودَع (الأمرَ إلى الحاكم، فإن وجد) الحاكمُ
