(وإن تلفت) الوديعة أو نحوها (عند الوارث قبل إمكان رَدِّها، لم يضمنها) لأنه لم يفرِّط (وإلا) بأن أخَّر الردَّ، أو الإعلام فوق ما يمكنه، وتلفت (ضَمِنـ) ها؛ لتفريطه بالتأخير.
