(ثم إن قامت بينة بالعين لآخذ القيمة سلِّمت إليه) العين، للبينة، وتقديمها على القُرعة (وردت القيمة إلى المودَع، ولا شيء للقارع) على المودع؛ لأنه لم يفوِّت عليه شيئًا, بل المفوت البينة.
