(وليس لواجده) أي: العبد (بيعه، ولا تملكه بعد تعريفه) لأن العبد يتحفَّظ بنفسه (فهو كضوالِّ الإبل) لكن جاز التقاطه؛ لأنه لا يؤمن لحاقه بدار الحرب، وارتداده، واشتغاله بالفساد.
