(فإن) ضاعت منه، فـ ( التقطها آخر، فعَلم) الثاني (أنها ضاعت من الأول، فعليه) أي: الثاني (ردها إليه) أي: الأول؛ لأنه قد ثبت له حق التمول، وولاية التعريف والحفظ، فلا يزول ذلك بالضياع.
