(ولا يُقَرُّ) اللقيط (بيد صبي، و) لا بيد (مجنون، و) لا بيد (سفيه، و) لا بيد (فاسق) ظاهر الفسق؛ لما تقدم (و) لا يُقر - أيضًا - بيد (كافر، واللقيط مسلم) لانتفاء ولاية الكافر على المسلم، ولا يؤمن فتنته في الدِّين (ولا) يُقر اللقيط - أيضًا - (بيد رقيق بلا إذن سَيّده) لانتفاء أهليته للحضانة والولاية على الأحرار.
