(وليس له) أي: القِن (التقاطُه بغير إذْنِ سيِّده) لأنه مستحق المنفعة للسيد (إلا ألّا يجد) الرقيق (مَنْ يلتقطه، فيجب) على الرقيق (التقاطه؛ لأنه تخليص له) أي: اللقيط (من الهلكة) وهو واجب في هذه الحال؛ لانحصاره فيه
