(فإن كان الملتقَط) بفتح القاف،

وفي نسخ: اللقيط (قد تصرف قبل ذلك) أي: قبل أن يحكم به لمدعي رقه ببينة (ببيع أو شراء) أو هبة ونحوها (نُقضت تصرفاته) لأنه بأن أنه كان تصرف بغير إذن سيده.
