(وليس له) أي: الموقوف عليه (وَطء الأَمَة، ولو أذن فيه الواقف) لأن ملكه ناقص، ولا يمكنه مَنْع حبلها، فتنقص، أو تتلف، أو تخرج من الوقف، بأن تبقى أُمّ ولد.
