(وإن كان) الموقوف عليه (غير معيَّن كـ) العبد الموقوف على (المساكين) إذا جنى، (فـ) أرش جنايته (في كسبه) لأنه ليس له مستحق معيَّن يمكن إيجاب الأرش عليه، ولا يمكن تعلقها برقبته، فتعين في كسبه.
