(وإن مات واهب قبل إقباض ورجوع) لم تبطل الهبة؛ لأنه عقد مآله إلى اللزوم، فلم ينفسخ بالموت، كالبيع في مدة الخيار، و (قام وارثه (٢) مقامه في إذن) في قبض (و) في (رجوع) في الهبة.
