كشاف القناعal-Buhuti

(وكذا لو كان) الحمل (من كافر غيره) أي: الميت (فأسلمت أُمّه قبل وضعه، مثل أن يخلف) كافر (أُمّه) الكافرة (حاملًا من غير أبيه) ثم تسلم، فيتبعها حملها ولا يرث؛ للحكم بإسلامه قبل الوضع. وعلى مقتضى القول بأنه يرث بالموت، يرث هنا - أيضًا - لتأخر الإسلام عنه.
